Terms of Service

1. Acceptance of Terms

By creating an account, making a booking, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and any additional policies referenced herein.

2. Eligibility

To use the Service you must:

• Be at least 18 years old (21 for premium vehicles)
• Hold a valid, unexpired driver's license
• Have a clean driving record acceptable to our insurance partners
• Pass our KYC (Know-Your-Customer) verification
• Have legal capacity to enter into binding contracts

3. Account Registration & KYC

You must provide accurate, current, and complete information during registration and KYC verification. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. We reserve the right to suspend or terminate accounts that provide false information or fail KYC checks.

4. Booking & Rental

• Bookings are subject to vehicle availability and confirmation
• You must present a valid ID and driver's license at vehicle pickup
• Rental begins at the agreed pickup time and ends at the agreed return time
• Only authorized drivers listed on the booking may operate the vehicle

5. Payment & Pricing

• Security deposit: a refundable deposit is required at booking
• Daily rate: calculated per 24-hour period from pickup
• Late-return fee: hourly surcharges apply beyond the return time
• Additional fees: fuel, tolls, fines, cleaning, and damage fees (where applicable)
• All prices are displayed in Malaysian Ringgit (MYR) unless otherwise stated
• Payments are processed by Stripe; you authorize us to charge your chosen payment method

6. Vehicle Use

• Vehicles may only be used on paved public roads in Malaysia (unless otherwise agreed)
• No off-road driving, racing, towing, or commercial ride-hailing
• No smoking, vaping, or transporting pets without prior written consent
• No transportation of illegal substances or contraband
• Drivers must obey all traffic laws and maintain proper insurance coverage
• Comprehensive insurance is included; the deductible amount is disclosed at booking

7. Cancellation & Refund Policy

• > 48 hours before pickup: full refund
• 24–48 hours before pickup: 50% refund
• < 24 hours before pickup or no-show: no refund
• Deposits are refunded within 7–14 business days after successful return

8. Damage & Liability

You are responsible for any damage to the vehicle during the rental period up to the insurance deductible. Traffic violations, parking fines, and toll charges incurred during the rental are your responsibility. We may charge these amounts to your payment method on file after providing reasonable documentation.

9. Prohibited Conduct

You agree not to:

• Provide false information or commit fraud
• Use the Service in any unlawful manner
• Permit unauthorized persons to operate the vehicle
• Reverse engineer, scrape, or interfere with the Service
• Circumvent security measures or access controls

10. Intellectual Property

The P2X Drive name, logo, website, mobile applications, and all associated content are the intellectual property of P2X Network Inc. and its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. All other rights are reserved.

11. Limitation of Liability

To the maximum extent permitted by law, P2X Network Inc. and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service. Our aggregate liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless P2X Network Inc., its officers, directors, employees, and agents from any claims, damages, liabilities, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms, or your violation of any law or third-party right.

13. Dispute Resolution

These Terms are governed by the laws of Malaysia for Malaysia-based users and the laws of the State of Colorado, USA for US-based users, without regard to conflict-of-law principles. Any disputes shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration or the courts of competent jurisdiction in the relevant territory.

14. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated by email or in-app notice at least 30 days before taking effect. Continued use of the Service constitutes acceptance of the revised Terms.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or as required by law. You may close your account at any time by contacting us. Provisions concerning liability, indemnification, and intellectual property shall survive termination.
